Family proceedings involve complex dynamics which require finely balanced decisions to avoid undue delay in securing positive outcomes for children and young people. Guardians must undertake comprehensive enquiries to understand the child and young person’s lived experience taking account of:

  • The child or young person’s history 
  • The child or young person’s health and development
  • The child or young person’s psychological, emotional and educational needs
  • The child or young person’s relationship to and attachment with parent(s) or carer 
  • The child or young person’s identity, ethnic, cultural and religious needs
  • The impact on the child or young person of the parent’s or carers ability, their insight into the concerns and their capacity to meet the child or young person’s needs.

In addition, the Guardian assessment takes account of the paramountcy principle and safeguarding concerns balanced with human rights requirements.
